GIFTO DIGITAL GIFT CARD TERMS & CONDITIONS
These Terms and Conditions apply to the GIFTO Digital Gift Card (“GIFTO Card”). Please read them carefully before purchasing, sending, redeeming, or using a GIFTO Card.
1. Acceptance of Terms
1.1 These Terms and Conditions form a legally binding agreement between:
(a) the purchaser, recipient or user of a GIFTO Card (“you”, “your”); and
(b) The Greater Union Organisation Pty Ltd ABN 99 000 024 439 of 478 George Street, Sydney NSW 2000, Australia, being a member of the EVT Limited group of companies, together with its service providers, including Karta Co.
1.2 References in these Terms and Conditions to “EVT” are references to EVT Limited ABN 51 000 005 103 and its related bodies corporate, including The Greater Union Organisation Pty Ltd ABN 99 000 024 439, unless the context requires otherwise.
1.3 The GIFTO Card is issued by 545490 Pty Ltd trading as Karta Co ABN 83 648 605 225 (“Karta”). The Greater Union Organisation Pty Ltd (the Company), as part of the EVT group, is the distributor of the GIFTO Card and is responsible for certain cardholder services.
1.4 By purchasing, sending, receiving, activating, accessing or using a GIFTO Card, you agree to be bound by these Terms and Conditions, as amended from time to time.
1.5 If you purchase and send a GIFTO Card to another person, you are responsible for ensuring that the recipient is aware that their use of the GIFTO Card is subject to these Terms and Conditions.
2. About the GIFTO Card
2.1 The GIFTO Card is a prepaid digital stored‑value gift card.
2.2 GIFTO Cards are available in digital form only and are accessed via the GIFTO mobile application (“App”) and compatible digital wallets.
2.3 GIFTO Cards may only be used at Participating Venues operated by, or affiliated with, The Greater Union Organisation Pty Ltd and its related entities, as listed from time to time at https://gifto.gift/venues (“Participating Venues”). The list of Participating Venues may change without notice.
2.4 Participating Venues means the venues, businesses or locations operated by, or affiliated with, EVT and its related bodies corporate at which a GIFTO Card may be used, as listed from time to time at https://gifto.gift/venues.
3. Accounts and Eligibility
3.1 You do not need to create an account to purchase a GIFTO Card.
3.2 To receive, access, store or spend a GIFTO Card, you must:
(a) create and maintain a GIFTO account via the App;
(b) provide accurate, current and complete personal information; and
(c) comply with all applicable system, device and software requirements.
3.3 You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account.
3.4 We may suspend or terminate your account, or restrict access to a GIFTO Card, where we reasonably believe you have breached these Terms and Conditions, provided false information, or engaged in unlawful or fraudulent conduct.
3.5 You may request deletion of your GIFTO account at any time by contacting GIFTO support via the App or at https://gifto.gift/
3.6 We may require you to verify your identity before processing any account deletion request.
3.7 Upon confirmation of a valid request, we will deactivate your account and remove your access to the App and associated account features.
3.8 Deletion of your account does not:
(a) cancel, refund or transfer any valid GIFTO Card balance;
(b) affect completed transactions;
(c) affect any rights or obligations accrued prior to deletion; or
(d) limit our ability to retain transaction records and related information where required to comply with legal, regulatory, taxation, accounting, fraud prevention or dispute resolution obligations.
4. Recipient Consent
4.1 If you send a GIFTO Card to a recipient electronically (including via SMS or email), you confirm that:
(a) you have obtained the recipient’s consent for us or our service providers to contact them for the purpose of delivering and administering the GIFTO Card; and
(b) the contact details you provide are accurate and belong to the intended recipient.
4.2 We are not responsible for GIFTO Cards delivered to an incorrect or unintended recipient as a result of incorrect contact details provided by you.
4.3 By creating an account or using a GIFTO Card, you consent to receiving operational communications relating to your GIFTO Card, including delivery notifications, balance updates, expiry reminders and security-related messages. Marketing communications will be sent only where you have separately opted in, and you can easily opt-out of these marketing communications at any time by using the links provided.
5. Purchase and Delivery
5.1 GIFTO Cards may be purchased through approved digital channels using accepted external payment methods. GIFTO Cards are not purchased through in-app purchases within the App. The App is used solely to access, store and use a GIFTO Card once issued.
5.2 Payment must be made in full at the time of purchase. Orders will not be processed until payment is successfully received.
5.3 Once issued, a GIFTO Card cannot be cancelled, refunded or exchanged, except as required by law.
5.4 We reserve the right to refuse or cancel any GIFTO Card order where we reasonably suspect fraud, unauthorised activity or breach of these Terms and Conditions. .
6. Mobile Application, Digital Wallets and Use
6.1 Access to and use of a GIFTO Card requires the GIFTO mobile application (“App”) to be downloaded and installed on a compatible iOS or Android mobile device.
6.2 Your mobile device must:
(a) support the current versions of iOS or Android as specified by GIFTO from time to time; (b) support Apple Pay® (for iOS devices) or Google Pay® (for Android devices); and
(c) have contactless payments enabled.
6.3 To use a GIFTO Card, you may be required to agree to the applicable Apple App Store, Google Play Store, Apple Pay® and Google Pay® terms and conditions. Apple Inc. and Google LLC provide digital wallet and app marketplace services only. They are not responsible for the availability, performance or operation of those services, or for any transactions made using them.
6.4 Continued access to the App and GIFTO Card functionality may require installing updates to the App or your mobile device operating system. Failure to install updates may limit or prevent access.
6.5 Once added to your Apple Pay® or Google Pay® digital wallet, a GIFTO Card can be used to make contactless payments at Participating Venues that accept the relevant digital wallet.
6.6 You acknowledge and agree that:
(a) you are responsible for selecting the correct card when making a payment;
(b) an internet connection is required to access the App and view your GIFTO Card;
(c) the App or GIFTO Card services may be unavailable from time to time due to maintenance, updates or technical issues; and
(d) some transactions may be declined due to technical or operational reasons.
6.7 GIFTO Cards:
(a) can be used for purchasing goods and services at Participating Venues only;
(b) cannot be used at ATMs or over the counter at financial institutions;
(c) cannot be redeemed for cash, reloaded, or consolidated with other gift cards;
(d) cannot be used to purchase other gift cards or vouchers; and
(e) may be subject to merchant‑specific conditions, authorisation limits or temporary pre‑authorisations.
6.8 If the purchase amount exceeds the available balance on the GIFTO Card, you may be required to pay the difference using another accepted payment method.
6.9 GIFTO Cards may be subject to merchant-specific conditions, authorisation limits or temporary pre-authorisations. Some merchants (including hotels, restaurants and entertainment venues) may place a temporary pre-authorisation on your GIFTO Card that is higher than the final transaction amount. This amount will temporarily reduce your available balance and will be adjusted once the transaction is finalised. .
7. Expiry and Balance
7.1 Each GIFTO Card is valid for three (3) years from the date of purchase, unless earlier exhausted.
7.2 Any unused balance remaining after expiry will be forfeited and will not be refunded or credited.
7.3 You are responsible for checking the balance and expiry date of your GIFTO Card via the App or other approved digital channels.
8. Lost, Stolen or Compromised Devices and Accounts
8.1 GIFTO Cards exist in digital form only and are accessed via your GIFTO account and Apple Pay® or Google Pay® digital wallet. There is no physical card.
8.2 If your mobile device is lost or stolen, or if you believe your account or digital wallet has been compromised, you should immediately secure your device, update your account credentials and notify GIFTO support via the support center available at https://support.gifto.gift
8.3 You are responsible for maintaining appropriate security settings on your device, account and digital wallet.
8.4 To the extent permitted by law, EVT and The Company are not responsible for unauthorised transactions resulting from your device, account or digital wallet being lost, stolen or compromised, except where caused by their negligence or breach of law.
9. Refunds and Disputes
9.1 Any disputes or issues relating to goods or services purchased using a GIFTO Card must be resolved directly with the relevant Participating Venue.
9.2 Refunds are subject to the policies of the Participating Venue and will not be credited back to the GIFTO Card unless required by law.
10. Fees
10.1 Fees and charges associated with the purchase or use of a GIFTO Card (including processing fees) will be disclosed at the time of purchase.
10.2 Participating Venues may impose additional fees or pre‑authorisation amounts in accordance with their own policies.
11. Prohibited Use
11.1 You must not use, or attempt to use, a GIFTO Card:
(a) for unlawful, fraudulent or misleading purposes;
(b) in a way that breaches these Terms and Conditions; or
(c) in a manner that may cause harm to EVT, The Company, their partners or Participating Venues.
11.2 We may suspend, cancel or block a GIFTO Card or account where we reasonably suspect misuse, fraud or unlawful activity.
12. Intellectual Property
12.1 All intellectual property rights in the GIFTO Card, App, branding and related content are owned by or licensed to The Company or its licensors.
12.2 You must not use our name, logos or branding without prior written consent.
12.3 You acknowledge that additional trade marks, service marks and intellectual property may be owned by third parties, including Karta Co, Apple Inc. and Google LLC. Nothing in these Terms and Conditions grants you any right, title or interest in those trade marks or intellectual property.
12.4 Apple Pay® is a registered trademark of Apple Inc. Google Pay® is a registered trademark of Google LLC.
13. Privacy
13.1 We collect, use and disclose personal information in accordance with applicable privacy laws and the GIFTO Privacy Policy available at https://gifto.gift/privacy-policy/.
14. Limitation of Liability
14.1 Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law.
14.2 To the maximum extent permitted by law, our total liability arising in connection with a GIFTO Card is limited to the remaining balance on the GIFTO Card.
14.3 We are not liable for indirect or consequential loss arising from the acts or omissions of Participating Venues.
15. Changes
15.1 We may update these Terms and Conditions from time to time. Updated versions will be made available via GIFTO channels.
15.2 Changes that materially disadvantage you will not apply to GIFTO Cards already issued, unless required by law
16. General
16.1 These Terms and Conditions are governed by the laws of New South Wales, Australia.
16.2 If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
16.3 These Terms and Conditions constitute the entire agreement between you and The Company in relation to the GIFTO Card.
